In the Province of New Brunswick, personal support professionals may hold one of the following titles depending on care setting:
For the purposes of this Agreement, PSW, PCA, and HCA are used interchangeably and the individual is referred to as the "PSW/PCA".
Regulatory Note: PSW/PCAs in New Brunswick are not provincially regulated under mandatory legislation. Standards are governed by employer policy, NBCC's Health Care Aide training, and voluntary alignment with the New Brunswick Health Care Association (NBHCA) and the Canadian Home Care Association (CCHA).
The PSW/PCA agrees to provide personal support and patient care services at healthcare facilities, long-term care homes, retirement residences, and/or private residences as assigned by Medloc. Services include, but are not limited to:
The PSW/PCA shall work under the direction and supervision of a licensed nursing professional. The PSW/PCA shall not perform any act outside their training and provincial scope of practice.
As a condition of this Agreement, the PSW/PCA confirms and agrees to maintain:
The PSW/PCA will be compensated at the following hourly rates (CAD), representing total take-home pay prior to applicable statutory deductions. Rates are effective January 1, 2026.

4.1 — Outbreak Protocol Premium: When a facility declares an active outbreak (e.g., influenza, COVID-19, gastrointestinal illness), all shifts worked under outbreak conditions are compensated at $40.00/hr. The outbreak premium replaces (does not stack with) the evening or overnight differential.
4.2 — Emergency Backup Premium: If the PSW/PCA accepts a shift with less than four (4) hours of advance notice at Medloc's request, the Emergency Backup rate of $40.00/hr applies for the full duration of that shift.
4.3 — Minimum Shift Duration: A minimum of two (2) hours will be paid for any confirmed shift, even if the PSW/PCA is sent home early at the facility's direction.
4.4 Medloc reserves the right to update this rate schedule with 30 days written notice. Rates will never decrease during the term of this Agreement.
5.1 Medloc shall process payment for completed shifts within 24 hours of shift completion and submission of an approved timesheet or digital check-in/check-out confirmation. Payments are made via direct bank transfer (EFT).
5.2 The PSW/PCA is responsible for accurately logging shift hours through the Medloc platform. Discrepancies must be reported within 48 hours of shift end.
5.3 The rates in Section 4 are the net amounts paid directly to the PSW/PCA. No further deductions are made by Medloc. Statutory deductions (CPP, EI, income tax) remain the PSW/PCA's responsibility as an independent service provider, unless otherwise agreed in writing.
The PSW/PCA agrees at all times to:
7.1 The PSW/PCA agrees to comply with all PPE requirements mandated by the assigned facility, including gloves, gown, surgical mask, eye protection, and N95 respirator where required and fit-tested.
7.2 — During Outbreak Protocol: The PSW/PCA is required to complete facility-specific outbreak orientation upon arrival, adhere to enhanced PPE protocols (N95 or higher), follow restricted movement pathways, and report any symptoms of illness to the supervising nurse and Medloc immediately. Symptomatic workers must not report for duty.
7.3 Medloc will notify the PSW/PCA of active outbreaks before the shift begins. By accepting an outbreak-designated shift, the PSW/PCA acknowledges awareness of the enhanced conditions and accepts the Outbreak Protocol rate.
8.1 The PSW/PCA agrees to maintain strict confidentiality of all patient, resident, and facility information encountered during their duties, in accordance with the Personal Health Information Privacy Act (PHIPA) and New Brunswick's Right to Information and Protection of Privacy Act (RTIPPA).
8.2 The PSW/PCA shall not disclose, photograph, record, or transmit any personally identifiable health information (PIHI) of patients or residents, or any confidential facility information, to any third party without express written consent.
8.3 This confidentiality obligation survives the termination of this Agreement indefinitely.
9.1 Either party may terminate this Agreement with a minimum of 72 hours' written notice delivered via email to the registered contact on file.
9.2 Medloc may terminate immediately and without notice in the event of: a no-call no-show on an assigned shift; confirmed abuse or neglect of a patient or resident; breach of confidentiality; criminal charges related to workplace conduct; falsification of credentials or timesheets; or attending a shift while impaired.
9.3 Upon termination, the PSW/PCA will be paid for all hours worked and confirmed prior to the termination date.
10.1 — Governing Law: This Agreement is governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada.
10.2 — Independent Contractor: The PSW/PCA is engaged as an independent service provider and not as an employee of Medloc, unless a separate written employment agreement specifies otherwise. Medloc shall not withhold income tax, CPP, or EI premiums unless required by law or separate agreement.
10.3 — Dispute Resolution: In the event of a dispute, both parties agree to first attempt resolution through good-faith written communication. If unresolved within 15 business days, either party may pursue mediation before seeking legal remedies.
10.4 — Entire Agreement: This Agreement supersedes all prior verbal or written representations. Amendments must be in writing and signed by both parties.
10.5 — Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
